This Privacy Policy explains the types of customer personal information Trajekt Sports Inc., a Canadian corporation, and/or its affiliates (collectively, “Trajekt” or “we,” “us,” or “our”) collect, how it is used, and the steps we take to ensure your personal information is handled appropriately.
This policy describes the types of information we may collect from you or that you may provide when you visit the website available at https://www.trajektsports.com (our “Website”) or otherwise use our Website(s) or the application (the “App”) (collectively referred to as services the “Services”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.
Please note: Trajekt Sports Inc. pitching machines are operated by independent organizations who are responsible for adopting their own privacy policies which meet the intent of this policy.
This policy may change from time to time. Your continued use of our Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

PERSONAL INFORMATION WE COLLECT
In this Privacy Policy, we use the term “personal information” to refer to information that can be used by itself or in combination with other available information to identify or be associated with you. Directly identifying information includes, for example, information such as your name, e-mail address, and date of birth. Personal information that is associated or linked to you includes data related to your interaction and usage of our Services.
Please note once you consent to the use of your Performance Data during the log in process, the App will automatically track your Performance Data unless you explicitly opt out of tracking. To opt out please see Section 6 “Choices About How We Use And Disclose Your Information.” To see how we use and share your performance information See Section 4 “How Do We Use Your Personal Information?” and Section 5 “Sharing Your Personal Information.”
By Performance Data we mean: (i) Activity metrics: number of swings, shots, passes, or hits; time spent performing exercises; repetitions or sets completed; (ii) Accuracy & precision: how close a user comes to a target (e.g., hitting a ball to a specific spot); (iii) Skill improvement trends: progress tracking over time, comparing current performance with past sessions; (iv) Comparative stats: benchmarking against other users or standard performance metrics. The Performance Data may contain information such as your name, name of the pitch to be replicated, and inbound pitch metrics. Optionally, and only if you opt in, it may also include outbound batted ball results data and video of your swing.
Our Services are not intended for children below 18 and we do not knowingly collect personal information of children under 18 years of age.
We may collect the personal information and sensitive personal information categories listed in the table attached.
2. HOW WE COLLECT PERSONAL INFORMATION
The Services may collect information from users and users’ devices, as follows:
Directly from you. For example, when you sign up for a newsletter, participate in polls, contests, create an account with the App, we collect certain information from you, including your name, and billing address.
Information from Affiliates and Related Companies. We may receive information that affiliates or related companies have collected from a user or device through their account systems, products, or services. For example, if you log in via a third-party platform.
Information from Third Parties. We may receive information that third parties have collected from a user or device through their services. Such access and use will be consistent with the third party's privacy policy.
Indirectly from you. When you visit the Services, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Services, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Website, and information about how you interact with the Services. We refer to this automatically-collected information as “Device Information”.

As you navigate through and interact with our services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
Details of your visits to our Website or use the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Services.
Information about your computer and internet connection, including your IP address, operating system, and browser type.
The App will automatically track your Performance Data.
3. COOKIE, PIXEL TAGS AND SIMILAR TECHNOLOGIES
The technologies we use for this automatic data collection may include:
Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website. Web Beacons. Pages of our Website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
Third-Party Use of Cookies and Other Tracking Technologies
Some content or applications on the Website are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties' tracking technologies or how they may be used. 4. HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the personal information that we collect generally to enable the functionality of the Services, complete and ship your orders, tailor services, and send news and updates.
Additionally, we use information collected for a variety of business purposes such as:
Performing statistical analyses of user behavior and characteristics, in order to measure interest in and use of the various sections of the Services to improve design and navigation and to gather marketing information. Only aggregated data from these analyses, not individual data, will be used for this purpose.
Enhancing user experience, and support research aimed at understanding and improving athletic performance. Performance Data may also be used de-identified form for analytical purposes, including third-party research, marketing, and analytics. We do not share personally identifiable information associated with Performance Data with third parties without your consent, except as described in this policy or as required by law.
Providing you with tailored content, services, advertisements and offers from our brands;
Responding to your questions and providing news and updates from our brands, about our products, services and loyalty programs;
Providing you with ordered products and access to features of the Services;
Verifying your identity;
Communicating about your account(s) and activities on the Services;
Sending notice of changes to our policies;
Improving the effectiveness of our Services, customer service and product offerings;
To conduct research and analytics related to our operations;
To protect our legal rights and interests and inforce our Terms of Service;
Processing applications and transactions;
Posting your content and consumer reviews on the Services, our social media pages and related third party sites and products; and
Contacting you about content shared by you about our products.
5. SHARING YOUR PERSONAL INFORMATION
We share your personal information with the following categories of service providers:
Third-Party Service Providers: We share information, including certain personal information, with our third-party service providers that we use to: process authentication and log-in information; provide hosting for and maintenance of our Services, e-mail marketing, solicit investors, scheduling meetings, backup, storage, payment processing, analytics and other services for us. These third-party service providers may have access to or process your personal information for the purpose of providing these services for us.
Analytics: We may collect, and we may engage third-party analytics providers to collect, metrics and information regarding your use of the Services, including evaluating how visitors use our Services to develop new features, improve existing features or inform sales and marketing strategies. We may share your Performance Data with third parties for research and marketing purposes. You will not share your Performance Data unless you specifically opt in to the collection and sharing of your Performance Data when you create an account or log in to the App.
Advertising and Marketing: We may use third-party advertising companies to serve advertisements on our Services and on selected websites and mobile applications operated by others. These companies may set their own cookies or use similar web technologies to collect information about your online and mobile device activities over time and across different websites. These companies then may direct advertisements to you based on your interests as suggested by the history of your visits to Services and other websites or mobile applications.
Affiliates: We may share information, including personal information, with companies affiliated with us, and they will use that information only for the purposes that are consistent with those described in this Privacy Policy.
Legal or Regulatory Purposes: We share information with governmental and regulatory entities as necessary to fulfill our legal obligations, comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
Promotional and Reward Partners: We may share information, including personal information, to third-party service providers.
6. CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:
Communications: You may elect to unsubscribe from promotional communications at any time by following the instructions in any marketing email you get from us. Please note that your opt out is limited to the email address used and will not affect subsequent subscriptions or non-promotional communications, such as replies to any communications from you or any notifications we may send regarding changes to this Privacy Policy or Terms of Service.
Registration Data: Should we ever offer you the opportunity to create an account to access certain features, it may include functionality allowing you to view, update, and/or edit the registration data you provide.
Performance Data: Please note that once you consent to the use of your Performance Data during the log-in process, the App will automatically track your Performance Data. If you wish to opt out of this tracking, you can do so at any time. To opt out, navigate to the Settings page in the App, select Privacy Settings, and toggle off the option labeled Share Performance Data. Once disabled, the App will no longer share your Performance Data for research, analytics, or marketing purposes. Please note that even if you opt out, certain Performance Data will still be collected to enable core App functions, such as tracking your progress, setting and monitoring goals, and improving your overall performance experience.
Cookies: You may be able to exercise certain controls through the settings available to you through your web browser or device or certain third-party browser extensions. If you elect to reject certain cookies, please note that you may not be able to take full advantage of all of the features and functions of the Services. You may also learn how to opt out of Google Analytics using the link provided above.
Do Not Track: Certain web browsers may allow you to send “Do Not Track” requests. We do not currently take actions to respond to Do Not Track signals because there is no current industry standard concerning what, if anything, websites should do when they receive such signals. Opt-Out Preference Signal: You may opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

7. YOUR PRIVACY RIGHTS
California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

Automated decision-making: We do not engage in decision making based solely on automated processing or profiling in a manner which produces a legal effect (i.e., impacts your legal rights) or significantly affects you in a similar way (e.g., significantly affects your financial circumstances or ability to access essential goods or services).
Right to Appeal. This right provides you with the opportunity to appeal a decision made by us in connection with a rights request.
8. YOUR CALIFORNIA PRIVACY RIGHTS
If you are a California resident, then under the California Consumer Privacy Act of 2018 and its implementing regulations, as amended by the California Privacy Rights Act (“CPRA”) (collectively, as it may be amended, “CCPA”), you have certain rights regarding your personal information.
California law provides you with specific rights regarding your personal information (as defined under the CCPA). These involve information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to, directly or indirectly, a particular consumer or household, subject to certain exclusions such as certain publicly available, aggregated, or deidentified information, and with certain exemptions such as information collected in an employment/contractor or business-to-business context. These rights include:
(A) The right to know what personal information the business has collected about the consumer, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom the business discloses personal information, and the specific pieces of personal information the business has collected about the consumer;
(B) The right to delete personal information that the business has collected from the consumer, subject to certain exceptions;
(C) The right to correct inaccurate personal information that a business maintains about a consumer;
(D) If the business sells or shares personal information, the right to opt-out of the sale or sharing of their personal information by the business;
(E) If the business uses or discloses sensitive personal information, the right to limit the use or disclosure of sensitive personal information by the business; and
(F) The right not to receive discriminatory treatment by the business for the exercise of privacy rights conferred by the CCPA, including an employee’s, applicant’s, or independent contractor’s right not to be retaliated against for the exercise of their CCPA rights.
Requests to Know or Delete
If you are a California consumer, you or your authorized agent may exercise these rights or request information about the Personal Information we have collected about you in the prior 12 months (as described under (a) above) or to request that we delete your information (as described under (b) above) by contacting us as specified below in Section “HOW TO EXERCISE MY RIGHTS”.
In the request, please specify which right(s) you are seeking to exercise and the scope of the request. In accordance with the CCPA, we may require additional information to verify your identity (or to verify that your authorized agent has the authority to make the request on your behalf) before responding to a CCPA rights request. If we are unable to so verify, we may deny your requests. We will confirm receipt and respond to all verified requests in accordance with applicable timelines required by the CCPA.

For purposes of California consumers, please see the following disclosures regarding how we (including our service providers on our behalf) may have collected, used, and disclosed your Personal Information collected in the previous 12 months in accordance with the CCPA. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations.
Your request must:
Provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of such person; and
Describe your request with sufficient detail for us to properly understand, evaluate, and respond to it.
If you wish to submit a verifiable consumer request on behalf of another individual, we will also need sufficient information to verify that the individual is the person about whom we collected personal information and that you are authorized to submit the request on their behalf. For requests to know, access, correct or delete personal information, we may ask you to provide sufficient evidence to show that you have provided the authorized agent signed permission to act on your behalf, verified your own identity directly with us pursuant to the instructions set forth in this Privacy Policy, and directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.
10. RESPONSE TIMING AND FORMAT
We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at privacy@trajektsports.com.
We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
11. NOTICE OF FINANCIAL INCENTIVE/ REWARDS PROGRAMS
We offer our customers a rewards program that provides certain perks, such as rewards and exclusive offers. We may also provide other programs, such as contests, or other similar promotional campaigns. When you sign up for one of these rewards programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number). Because our rewards programs involve the collection of personal information and offering of certain benefits, they might be interpreted as a “financial incentive” program under California law or a “bona fide loyalty program” under Colorado law. Under the California law, the value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable program, less the expense related to offering those products, services, and benefits to Program participants.

12. SECURITY AND DATA RETENTION
We take steps to safeguard your personal information, regardless of the format in which it is held, including:
physical security measures such as restricted access facilities and locked filing cabinets;
electronic security measures for computerized personal information such as password protection, database encryption and personal identification numbers We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you enter; and
organizational processes such as limiting access to your personal information to a selected group of individuals.
It is important for you to protect against unauthorized access to your password and your computer. Be sure to sign off when you have finished using any shared computer.
If you have reason to believe that your interaction with us is no longer secure or your security has been compromised, you must immediately notify us of the problem by contacting us as provided below.
We retain your personal data for as long as reasonably necessary for the purposes and criteria outlined in this Privacy Policy.
We will also retain and use your personal data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. For example, under certain accounting and tax laws we are required to store Commercial Information for long periods of time to comply with laws we are subject to. Therefore, even if you submit a data deletion request, a small portion of the data that relates to our compliance obligations will be stored even after the request is satisfied.

Our Services are not directed towards, and we do not knowingly collect, use, disclose, sell, or share any information about, children under the age of 18.
